1. Introduction

Welcome to jwlry.design. By accessing or using our website and AI-powered jewellery design services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you must not use our Services.

2. Service Description

2.1 AI Design Services

We provide AI-powered jewellery design image generation services using third-party AI providers. Our Services use artificial intelligence to create unique jewellery designs based on user inputs. We may change, update, or replace the underlying AI technology at any time without prior notice, provided the core functionality of the Services remains substantially similar.

2.2 Pricing

We offer pay-as-you-go pricing. Current pricing is displayed on our website at jwlry.design and may be updated from time to time. All prices are in US Dollars (USD). Payment is required before accessing the Services.

2.3 Eligibility

You must be at least 18 years of age to use our Services. By creating an account, you represent and warrant that you are at least 18 years old.

3. Intellectual Property Rights

3.1 AI-Generated Content

Images are generated using third-party AI services. Under Australian law, AI-generated content may have limited or no copyright protection where there is insufficient human authorship.

3.2 Your Rights

For images you generate through our Services, you receive:

All rights that exist in the generated images
Full commercial use rights
The right to create, sell, and distribute physical jewellery based on the designs
The right to modify and create derivative works
The right to sublicense or transfer your rights to others

3.3 Our Rights

jwlry.design retains the right to use all generated images for training and improving our AI models and services. This does not limit your commercial rights to the images you generate.

3.4 No Warranty of Rights

We make no warranty or representation about the existence, ownership, or scope of any intellectual property rights in AI-generated content. You are responsible for your own legal assessment of what rights exist in generated images.

4. User Obligations

4.1 Acceptable Use

You agree not to:

Generate content that infringes others' rights
Create misleading or deceptive designs
Attempt to reverse engineer our AI systems
Use the Services for unlawful purposes
Use automated tools, bots, or scripts to access the Services without our prior written consent

4.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorised access

4.3 Uploaded Content & Intellectual Property

jwlry.design respects and supports the creative work of jewellery designers worldwide. We do not condone, facilitate, or support copyright infringement in any form.

When you upload any images to our Services — including but not limited to reference photos, gemstone images, inspiration images, or any other visual content — you represent and warrant that:

You own the image, or you have obtained all necessary rights, licences, and permissions from the rightful owner to use and upload it to our platform;
The image does not infringe any third party's copyright, trademark, design right, or other intellectual property rights;
You will not upload photographs, renders, or reproductions of another designer's original work for the purpose of replicating, copying, or creating substantially similar designs without that designer's explicit written permission;
You accept full responsibility for any uploaded content and acknowledge that jwlry.design has no obligation to verify the ownership or licensing status of images you upload.

Our platform is designed to help you create original jewellery designs. Using another designer's work as the basis for AI-generated designs without permission is a violation of these Terms and may constitute copyright infringement under Australian and international law.

We reserve the right to remove any uploaded content and suspend or terminate accounts that we reasonably believe are being used to infringe the intellectual property rights of others.

5. Content Moderation

We take image safety seriously. Every image created by our AI and every image uploaded by our users is automatically screened against strict content policies. Anything that falls outside our guidelines is blocked before it is ever stored or displayed.

We reserve the right to remove any content that violates our content policies, and repeated violations may result in account suspension or termination. By using jwlry.design, you agree that all images — whether generated or uploaded — are subject to automated moderation at our discretion.

6. Payment and Credits

6.1 Fees

All fees are in US Dollars (USD)
Payment is required before service access

6.2 Image Credits

Image credits do not expire
Credits are non-transferable between accounts

6.3 Refunds

Credits are generally non-refundable once purchased. However, if an image generation fails due to a system error or technical fault on our end, the credit used for that generation will be automatically refunded to your account. No refunds will be issued for generations that complete successfully, regardless of whether you are satisfied with the output.

7. Content Storage and Backup

7.1 Storage Duration

Generated images are stored in your account for 100 days from the date of generation. After this period, images may be permanently deleted without notice. You are responsible for downloading and backing up any images you wish to keep. We do not guarantee perpetual storage of any content.

7.2 Data Recovery

Any data recovery is provided on a best-effort basis only. We make no guarantee of data recovery and strongly recommend you maintain regular backups of your generated designs.

8. Limitation of Liability

To the maximum extent permitted by law:

We provide the Services on an "as is" and "as available" basis, without warranties of any kind, whether express or implied
We do not warrant that the Services will be uninterrupted, error-free, or secure
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities
Our total aggregate liability to you for all claims arising from or related to these Terms or your use of the Services is limited to the total fees you have paid to us in the twelve (12) months preceding the claim
We are not responsible for the accuracy, quality, or suitability of any AI-generated designs for a particular purpose

9. Indemnification

You agree to indemnify, defend, and hold harmless jwlry.design, its owners, operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

Your violation of these Terms
Your misuse of the Services
Your infringement or alleged infringement of any third party's intellectual property rights, including through content you upload to the platform
Any claim by a third party that content you uploaded infringes their rights
Your breach of the representations and warranties in Section 4.3

10. Termination

10.1 By You

You may stop using the Services or request account deletion at any time by contacting us at info@jwlry.design. Purchased credits remain valid per Section 6.2 while your account is active. No refunds are issued for unused credits upon account closure.

10.2 By Us

We may suspend or terminate your access to the Services if you:

Violate these Terms
Engage in harmful or abusive conduct
Engage in fraudulent payment practices
Upload content that infringes third-party intellectual property rights

10.3 Effect of Termination

Upon termination of your account, whether by you or by us:

Your right to access and use the Services will cease immediately
Any unused credits will be forfeited and are non-refundable
Your generated images will be retained for 30 days following termination. During this period, you may contact us at info@jwlry.design to request account reinstatement and recover your images. After 30 days, all generated images may be permanently deleted without further notice
We may retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy

11. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, third-party service provider failures, or cyberattacks.

12. Dispute Resolution

If a dispute arises in connection with these Terms or the Services, the parties agree to first attempt to resolve the dispute informally by contacting us at info@jwlry.design. We will endeavour to respond within 14 days and work with you in good faith to reach a resolution. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal proceedings.

13. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of South Australia.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and jwlry.design regarding your use of the Services. These Terms supersede any prior agreements or communications, whether written or oral, relating to the subject matter herein.

17. Changes to Terms

We may modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will notify you via email to the address associated with your account. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms. If you do not agree with any changes, you should stop using the Services.
